Gone in a minute: Farlow protest rejected Attorney says he didn't miss noon deadline to appeal

The S.C. Election Commission is refusing to hear the appeal of an Orangeburg Consolidated School District 5 election, saying it was filed one minute too late.

The attorney for Samuel Farlow, who lost his bid for re-election to the school board, filed his appeal of the Nov. 6 election at 12:01 p.m. Monday, according to the state Election Commission. The deadline was noon.

"The appeal was filed, but it was not timely," said commission spokesman Chris Whitmire.

Whitmire said that Willie Brunson, Farlow's attorney, was told the appeal was filed too late, and that particular ruling will be affirmed in writing to him.

Farlow and former OCSD 5 Board Chairman Kalu Kalu challenged their election losses in hearings before the Orangeburg County Elections Board last week. The board rejected both challenges. While Kalu conceded, Farlow decided to continue with his appeal.

Farlow lost Seat 2 on the OCSD 5 board to Robert "Bo" Gathers by a margin of 446 votes to 423.

On Monday, Farlow said he could not comment on the state Election Commission's decision until he consulted with Brunson on the matter.

Brunson said he talked to the commission's secretary earlier that morning. However, he said when he arrived at the commission's office, she was not at the front desk.

When the secretary returned to her post, the clock on the wall still said noon, Brunson said. He said that the secretary then told him that she goes by the clock on a computer, which read 12:01 p.m. at the time.

Brunson said he argued that the time on the clock on the wall was the commission's notice to the public of the proper time, and suggested that the computer clock could very well be inaccurate.

"I vehemently objected at the scene. I've never been so disappointed in my life. It's a travesty," Brunson said. Brunson said he will file a motion to make an exception.

Brunson said he did not submit the appeal sooner because of the Thanksgiving holiday.

He submitted an eight-page brief to the commission for consideration in which he claimed there were several violations of state election laws, including uncounted ballots, incorrect official reports, malfunctioning voting machines and inappropriate procedure at a protest hearing.

During last week's protest hearing, two members of the Orangeburg County Elections Board voted in favor of Farlow, resulting in a tied vote. They later changed their votes after returning from executive session.

County Attorney D'Anne Haydel said there were no deliberations during that executive session, and it was only called to get an opinion from the state Election Commission on how to proceed.

Gathers said he is patiently waiting to take his seat, saying that both the people and the county elections board have spoken.

"I'm ready to take on the challenge. It's past time for change and everybody wants to see some results," Gathers said.

Whitmire said the election results will be forwarded to the S.C. Secretary of State for final ce.jpgication. Last week, the OCSD 5 board adjourned its meeting early due to the fact that the three newly elected trustees had yet to be ce.jpgied by the state and could not be sworn in to office.

"Once we hear back from the state as to whether the votes have been ce.jpgied, we will bring everybody on board at the next board meeting," said OCSD 5 spokesman Greg Carson. The next board meeting is scheduled for Dec. 11 at Bethune-Bowman Middle-High School.

" Bo knows more than victory he is an outstanding citizen of our community,I remember when Bo took responsibility for a little boy and mentored him.Bo treated that little boy like it was his own.Bo loved that boy and he was always there for him.Thanks Bo for being a Father to that boy when he needed one.The young man attends church with mr bo and he just loves mr. " 12 hours between postings is an awful long time to wait. Can't the micro-managing editor just provide basic guidelines for lower positions to follow and let the majority of post thru on a 4-5 hour basis? control freaks dont make good board managers. "

" I too have seen the folks sitting in chairs at each polling location, passing out sample ballots. I had always wondered about their affiliation. Curious as to why this has never been addressed before? It does seem a bit odd that Farlow's attorney waited so long to file the appeal. I am sure they had adequate time. " THE MAIN ISSUE AT HAND IS SCHOOL DISTRICT 5. DISTRICT 5 AS A WHOLE IS NOT DOING SO WELL WHEN IT COMES TO MEETING OBJECTIVES MANDATED BY THE STATE OF S.C.. HONESTLY, MR.GATHERS WON'T DO MUCH MORE THAN WHAT MR.FARLOW DID. OUR SCHOOLS ARE NOT MAKING THE GRADES FOR VARIOUS REASONS. 1) PARENTAL INVOLVEMENT IS AT AN ALL TIME LOW. ATLEAST 60% TO 70% OF OUR KIDS COME FROM SINGLE PARENT HOMES OR EITHER GRANDMA OR AUNTI IS TRYING TO FILL IN FOR THE BIOLOGICAL PARENTS. THIS FACTOR ALONE CAUSES MANY KIDS NOT TO CARE ABOUT THEIR OWN EDUCATIONAL CIRCUMSTANCE. 2)ALSO MANY GREAT TEACHERS ARE LEAVING THE FIELD OF EDUCATION OR JUMPING TO BETTER PAYING DISTRICTS ( MANY OF OUR RETIRING EDUCATORS ARE NOT BEING REPLACED BECAUSE MANY COLLEGE KIDS ARE NOT PURSUING DEGREES IN EDUCATION). 3) TEACHERS NO LONGER TEACH TO THE "CHILD," THEY TEACH TO THE TEST (P.A.C.T.). I wish they had allowed the appeal to go forward so that it could have been rejected for its lack of merit. " To the contrary, it is my understanding that Mr. Farlow and his attorney did not wait to file one minute after the deadline. They did not want to continue the controversy. Rather, the attorney arrived before noon and had to wait for an Election Commission employee who came to accept the motion one minute after noon (according to the computer clock not the clock on the wall). I don't think the Election Commission is involved in any conspiracy since conspiracy is an act involving a group or entitites plotting together. Based on this employee ignoring a clock visible to the public and this employee not promptly serving the public, the Election Commission was wrong all by itself. "

If it was so important to Farlow and his attorney, why didn't they file the motion earlier than one minute after the deadline. Obviously they waited to continue the controversy. Charges of harassment are more opinion than fact. Why would this be any different than the NAACP offering up ballots at the entrance to election places that are pre-marked and given to only black voters? "

" sc election commission already knew they would reject the appeal when lucky for them the deadline was missed by one minute. Offering the missed deadline as the reason the appeal was rejected is childish. I hope one day the strict down to the minute rule comes back to bite them in the butt. "

" If persons were harassed while voting, no one including Mr. Farlow, should let it go. If machines malfunctioned, no one including Mr. Farlow, should let it go. If votes were cast but not counted, no one including Mr. Farlow, should let it go. While life continues in other aspects even in Consolidated School District 5, there has been a major injustice here. I applaud the will and the decency to right a wrong. I wish we all had that will and decency but apparently not. Finally, victory is determined when there is right. As such, there is no victory here. "

I keep reading the quote that the people of Orangeburg have spoken... the people were not all that convince if the votes were that close!!! If it was me I would demand the same thing. I've worked the polls and I have seen first hand how human mistakes can be made. If everything was done on the up and up why not recount the votes. Is someone afraid that the outcome may be different the second time. If you’re confident about your win why not let them recount the votes? "
